LA ALTAGRACIA (Dominican Republic) is 16 years old, in the Vista Alegre community, in the La Otra Banda municipal district, and in the Higüey municipality.
The Public Ministry presented the accusation and the request to open a trial against Professor John Kelly Martínez and his cousin Rubiel Morillo Martínez, accused of the young woman’s death with the initials Esmeralda Richiez Martínez.
In the file presented before the court, the Public Ministry accuses Kelly Martínez of violating articles 265, 266, 302, 303, 303-4, 331 of the Dominican Penal Code, as well as article 396 literals A, B, C, of Law 136-03 of the Code for the System for the Protection of the Fundamental Rights of Boys, Girls and Adolescents and articles 66 and 67, of Law 631-16, for the Control and Regulation of Weapons and Related Materials.
In the case of Morillo Martínez, the body prosecuting the crime establishes that the defendant violated the provisions specified in articles 59, 60, 265, 266, 302, 303, 303-4, 331 of the Dominican Penal Code, article 396 literal A, B, C, of Law 136-03 of the Code for the System for the Protection of the Fundamental Rights of Children and Adolescents, and articles 66 and 67, of Law 631-16, for the Control and Regulation of Weapons and Related Materials.
The accusation indicates that on the night of February 12, the adolescent left home, where she lived with her parents in Vista Alegre, accompanied by the teacher, Morrillo Martínez, and three other underage students.
She indicates that, upon returning home, the young woman arrived pale and bleeding around midnight, so her parents helped her, and she stayed in her room.
