Federal Court in PA cites the Dominican Government through MIREX, JCE, and NY consulate in the case of 2020 foreign elections.

NEW YORK._ The Federal Court of the Eastern District based in Pennsylvania summoned the Dominican Government through the Ministry of Foreign Affairs (MIREX), the Central Electoral Board (JCE), and the general consulate based in this city for the case of the Dominican elections abroad 2020.

The lawyer Robert Robles who represents the plaintiffs headed by Dr. Yomare Polanco explained that the subpoena is an exception from the federal court because the three institutions mentioned above refused to process the warrants.

The notification for those involved in the 2020 electoral chaos to appear in court is based on file number 2:22-cv-02598-ER Folio 56, filed on February 6, 2023.
In an extensive bundle of pages, the court secretary reveals the list of those accused of the conspiracy to sabotage the 2020 elections abroad.

Federal court clerk George V. Wylesol says that the subpoena was sent to the Dominican Foreign Minister through the United States Government delivery company, Federal Express (FedEx), to the Dominican Foreign Ministry in Santo Domingo, Dominican Republic, to be delivered to the foreign secretary, via ECF file in response to the law firm, Kolman Law PC headed by renowned Pennsylvania-based attorney Timothy M. Kolman.

“In accordance with the procedures provided by your office for Service of a Summons to a Foreign Entity, please accept this letter presentation acknowledging that the Summons [ECF 11], a copy of the English Amended Complaint [ECF 5], and Complaint amended translated into Spanish [ECF 12] has been sent via Federal Express to the Dominican Minister of Foreign Affairs, to the attention of Roberto Álvarez Gil, Puerta Principal this February 6, 2023”, explains the firm.

Dr. Robles explained that the summons is not the foreign ministry but the country itself. Still, it was sent to MIREX because it officially represents the Dominican Republic in foreign affairs involving the Dominican state.

“It is a subpoena and the date begins at the moment they receive it,” added the civil and constitutional rights legal specialist.
“The case is different for individuals,” he added, referring to the defendants in the Yomare Polanco vs. Dominican Republic case file.
“The country, the JCE and the consulate are being cited because they represent the Dominican Republic abroad,” the lawyer added.

He said the United States treats sovereign countries differently than a person or a company.

“The court sent them the summons and they have 60 days to respond, if they don’t respond within that period, it is extended to 30 more days and the Department of State will notify the chancellor about the last term,” he added.

“If those 30 days end and there is no response, we have the right to request that the magistrate declare the Dominican Republic in default (default) and he could give us judicial victory without a fight,” the jurist reported.
